Terms of service
The short version
- Kapacity shows you comparisons of your own Strava activities. You need a Strava account to use it.
- The free plan is free. Kapacity Pro is US$99 per year, renews yearly until you cancel, and can be refunded in full within 7 days of any charge.
- Use Kapacity for yourself, lawfully, and don't try to break it or copy it.
- Kapacity is information, not medical or coaching advice.
Using Kapacity
You sign in with Strava. You must be at least 16, and old enough to agree to these terms where you live. Keep your Strava account secure: anyone who can sign in to it can see your Kapacity comparisons. Your use of Strava is governed by Strava's own terms.
Kapacity uses the Strava API but is not developed, sponsored or endorsed by Strava. Strava may change or stop its API, which can change or stop parts of Kapacity.
Your data
Your activities stay yours. You allow us to read them from Strava and process them only to show you Kapacity, as described in our privacy policy. You can disconnect at any time from Settings, which deletes everything we hold for you.
Plans and payment
- Free: one sport, comparisons over your last 3 months, and share images with a Kapacity watermark.
- Kapacity Pro: US$99 per year, plus any applicable sales tax or VAT. Your full history, running and cycling together, share images without a watermark, and comparisons downloadable as Excel spreadsheets.
Pro is sold by Paddle, our merchant of record. Paddle handles checkout, tax, receipts and your payment details, and its buyer terms apply to the purchase. Your receipt and card statement show Paddle.
Pro renews automatically each year at the price shown when it renews. If the price changes, we will tell you before your next renewal, so you can cancel first. Cancel any time from the link in your Paddle receipt or by emailing us; Pro then stays active until the end of the year you paid for.
Refunds: see our refund policy. In short, a full refund within 7 days of any charge.
Fair use
Don't:
- use Kapacity for anyone's activities but your own, or share your access;
- scrape, copy or resell Kapacity or its data, or use them to train artificial-intelligence or machine-learning models;
- try to get around its limits or plans, probe or overload it, or reverse-engineer it;
- use it in a way that breaks the law or Strava's terms.
We may suspend or close an account that does, and tell you why unless the law or security reasons prevent it.
Share images
"Download image" makes a picture of your comparison in your own browser. Where you post it is up to you, and you are responsible for what you share.
Not medical or coaching advice
Kapacity shows numbers Strava records, such as pace, heart rate and elevation. They can be wrong, and they are not medical, health or training advice. Talk to a qualified professional before changing how you train, especially after an injury.
Kapacity itself
Kapacity, its design and its code belong to RECON HQ INC.. We improve Kapacity over time and may change or remove features. If we stop offering Kapacity Pro, we will refund the unused part of your current year.
Disclaimers and liability
Kapacity is provided "as is" and "as available". As far as the law allows, we make no promises that it will be uninterrupted, error-free or fit for a particular purpose, and our total liability to you for any claim is limited to what you paid us for Kapacity in the 12 months before the claim. Nothing in these terms limits liability that the law does not allow us to limit, or any consumer rights you have where you live.
Ending
You can stop using Kapacity and disconnect at any time. We may stop providing Kapacity to you with reasonable notice, or immediately for a serious breach of these terms.
The law that applies
These terms are governed by the laws of the State of Florida, USA, and disputes go to the courts of Orange County, Florida, unless the consumer law where you live gives you the right to bring them where you live.
Changes
If we change these terms, we will update the date above and, for significant changes, tell you in the app before they take effect. If you keep using Kapacity after that, the new terms apply.
